NCR Debt Review Withdrawal Guidelines 2021


(Guideline 01/2021 – May 2021)

The NCR Debt Review Withdrawal Guidelines 2021, issued by the National Credit Regulator (NCR), provide clarity on the legal and procedural framework governing the withdrawal of consumers from the debt review process under the National Credit Act.


These guidelines were developed following significant legal developments, including the High Court judgment in Van Vuuren v Roets and Others, which clarified whether and under what circumstances a consumer may exit debt review where financial circumstances have improved. The document replaces previous withdrawal guidelines and sets out the principles that industry participants must follow when dealing with debt review withdrawal requests.


It also emphasises that compliance with the National Credit Act, its regulations, and applicable case law remains paramount.
