What are Debt Disputes

If you believe you already paid the debt, do not owe the debt, the amount is incorrect, or that it’s not even your debt, you may send a written request to the debt collector to dispute the debt or receive more information. 

If a debt collector contacts you about a debt you may or may not owe, don’t ignore or avoid a debt collector. Debt collectors are, in general, required by law to tell you certain information about the debt, and this information – also known as validation information or a validation notice – can help you learn more about the debt and dispute it if you don’t think that you owe it.

Once declared over indebted and accepted into debt counselling the following will happen

Legal Protection

Protection from legal action for a period of 60 days from the day of application, as long as you pay according to the new arrangement.

No more calls

You will be listed at the Credit Bureau as being under debt counselling. All your creditors will have to stop calling you and liaise with your debt counsellor.

Clearance Certificate

For as long as you are under debt counselling you will not be allowed to get credit until you are issued with a Clearance Certificate

Collecting prescribed debt is illegal

Before the amendments of the NCA, it was common for consumers to be chased for prescribed debt. The NCA amendments that came into effect in March last year declared the collection of prescribed debt to be illegal.

Where consumers have been contacted by debt collectors or third party agencies on behalf of a credit provider asking for payment on old potentially prescribed debt, consumers should not acknowledge the debt in question. Acknowledgment of the debt would break the cycle of prescription, making you liable for the debt again.

If you are contacted for old debt, take down the details of who is calling and which company they represent.

Reckless Lending

If you feel like your creditor has offered you more dent than you could afford of handle, you may be entitled to have that debt written off. This is known as reckless lending. Reckless lending is defined as when a creditor fails to conduct a detailed credit assessment as required by the National Credit Act (NCA) and still offers the consumer credit.

If you did not understand the risks, costs, and obligations created by the proposed credit agreement, such a credit agreement is considered reckless lending.
